a) What law applies?
In principle, we will only use your personal data in accordance with the applicable data protection laws, in particular Albania`s Law No. 9887 on Protection of Personal Data (“Law No. 9887”) and the General Data Protection Regulation (“GDPR”).

b) What is Personal Data?
Personal Data is any information relating to personal or material circumstances that relates to an individual. This may include, a name, date of birth, e-mail address, postal address, or telephone number but also online identifiers such as IP addresses or device ID`s.

c) What is processing?
“Processing” means any operation or set of operations which is performed upon Personal Data, whether or not by automatic means. The term is broad and covers virtually any handling of data.

d) Who is responsible for data processing?
The responsible party within the meaning of the Law No. 9887 and the GDPR is ELTADOR, Ismail Qemali Street, Building no.14, Apartment no.5, Tirana, Albania. e) What are the legal bases of processing?
In accordance with the Law No. 9887 and the GDPR, we have to have at least one of the following legal bases to process your Personal Data:

• you have given your consent,
• the data is necessary for the fulfillment of a contract / pre-contractual measures,
• the data is necessary for the fulfillment of a legal obligation or
• the data is necessary to protect our legitimate interests, provided that your interests are not overridden.

Data we collect automatically
On the basics of our legitimate interest and to make our website accessible to you, we (including third parties on our behalf) are collecting some personal data automatically. Without this data, you would simply not be able to access our website. The following provides an overview of what is collected and who is involved in the process.

a) Hosting
To provide our website, we use the services of WordPress by Automattic Inc, who process all data to be processed in connection with the operation of our website on our behalf.

b) Content Management System (CMS)
We also use the Content Management System (CMS) of WordPress to publish and maintain the created and edited content and texts on our website. This means that all content and texts submitted to us is transferred to WordPress.

c) Log data
When you visit our website, WordPress also automatically data from the visiting device and stores it in a so-called log file: i) Name of the retrieved file, ii) date and time of the visit, iii) amount of data transferred, iv) message about successful retrieval, type of browser and version used, v) IP address (identification of the user’s device), vi) Operating system of the visiting device, vii) Internet service provider of the visiting device, viii) website from which you access our website, and ix) which of our website pages you are accessing. The legal basis for processing is our legitimate interest.

d) Cookies
We use so-called cookies on our website. Cookies are pieces of information that are transmitted from our web server or third-party web servers to your web browser and stored there for later retrieval. We may also use similar methods, such as pixels, web beacons. For consistency, all of these methods are collectively referred to as “cookies”.

In accordance with Law No. 9887 and the EU`s Privacy and Electronic Communications Directive (“PECD”), we need to obtain consent for the use of non-essential Cookies. Doing so you will be prompted to make a selection on our use of cookies when you first visit our website by means a Cookie Consent Management Tool.

i) Why are cookies used?
There are several reasons why cookies are used. First, cookies may be necessary for the website to function properly. For example, without cookies, a website cannot remember that you are logged in or what products you have added to your shopping cart. These are so-called necessary cookies.

We also use Google Analytics provided by Google LLC, on our website. Google Analytics also uses cookies to enable our website to analyze how users use our website across multiple devices. The information generated by the cookies about your use of our website is transmitted to and stored by Google, including transmission to the United States.

The following data is processed through the use of Google Analytics: i) 3 bytes of the IP address of the called system of the website visitor (anonymized IP address), ii) the website called up, iii) the website from which the user reached the accessed page of my website (referrer), iv) the subpages accessed from the website, v) the time spent on the website, and vi) the frequency with which the website is accessed. Google states that it will not associate your IP address with any other data held by Google.

f) Google Fonts
We integrate the fonts of the provider Google LLC, whereby the user’s data is used solely for the purpose of displaying the fonts in the user’s browser. The integration is based on our legitimate interest in a technically secure, maintenance-free and efficient use of fonts, their uniform display and taking into account possible licensing restrictions for their integration.

Data we collect directly
On the basics of fulfilling or to entering into a contract with you, your consent, and in part our legal obligations, we are collecting personal data directly. This data is necessary for carrying out the work you are asking us to do, to invoice you and the payment of taxes etc. Without this data, we will usually have to refuse to conclude the contract or will no longer be able to perform an existing contract and may have to terminate it. The following provides an overview of what is collected and who is involved in the process.

a) Contacting us
Personal data is processed depending on the contact method. In addition to your name and email address, IP address or phone number, we usually collect the context of your message, which may also include certain Personal data.

b) Social Media
We are present on social media, if you contact or connect with us via social media platforms, we and the relevant social media platform are jointly responsible for the processing of your data and enter into a so-called joint controller agreement.

c) When using our services
We process the Personal Data involved in your use of our services in order to be able to provide our contractual services. This includes in particular our support, correspondence with you, invoicing, fulfillment of our contractual, accounting and tax obligations.

d) Administration, financial accounting, office organization, contact management
We also process your Personal Data in the context of administrative tasks as well as organization of our business, and compliance with legal obligations, such as archiving. In this regard, we process the same data that we process in the course of providing our contractual services.

General Principles
a) Who receives my data?
Within ELTADOR, those that need your data to fulfill our contractual and legal obligations will receive access to it.

Processors used by us may also receive data for these purposes. These are companies in the categories of IT services, telecommunications, and sales and marketing. Where we use processors to provide our services, we take appropriate legal precautions and corresponding technical and organizational measures to ensure the protection of personal data in accordance with the relevant legal provisions.

Data is only passed on to third parties within the framework of legal requirements. We only pass on users’ data to third parties if this is necessary, for example, for contractual purposes or on the basis of legitimate interests in the economic and effective operation of our business or you have consented to the transfer of data.

b) How long will my data be stored?
As far as necessary, we process and store your personal data for the duration of our business relationship, which also includes, for example, the initiation and execution of a contract.

In addition, we are subject to various storage and documentation obligations, which result from the minimum statutory retention periods and the Ministry of Finance, among others. The retention and documentation periods specified there are up to 10 years.

c) How do we secure your data?
Our website uses SSL or TLS encryption to ensure the security of data processing and to protect the transmission of content or contact requests that you send to us. We have also implemented numerous security measures (“technical and organizational measures”) for example encryption or need to know access, to ensure the most complete protection of Personal Data processed through this website.

Nevertheless, internet-based data transmissions can always have security gaps, so that absolute protection cannot be guaranteed. And databases or data sets that include Personal Data may be breached inadvertently or through wrongful intrusion. Upon becoming aware of a data breach, we will notify all affected individuals whose Personal Data may have been compromised as expeditiously as possible after which the breach was discovered.

d) Are data transferred to a third country or to an international organization?
Your data is not transferred to third countries (countries outside Albania and the EEA).

e) Special Category Data
Unless specifically required and explicit consent is obtained, we do not process special category data.

f) Minors
We do not request Personal Data from minors and children and do not knowingly collect such data or pass it on to third parties.

g) Automated decision-making
Automated decision-making is the process of making a decision by automated means without any human involvement. Automated decision-making including profiling does not take place.

h) Do Not Sell
We do not sell your Personal Data.

a) Privacy rights
Under the Law No. 9887 and GDPR, you can exercise the following rights:

• Right not to be subject to a decision based solely on automated processing.

d) Access Request
In the event that you wish to make a Data Subject Access Request, you may inform us in writing of the same. We will respond to requests regarding access and correction as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days, we will tell you why and when we will be able to respond to your request. If we are unable to provide you with any Personal Data or to make a correction requested by you, we will tell you why.

e) Complaint to a supervisory authority
You have the right to complain about our processing of Personal Data to a supervisory authority responsible for data protection.
